Terms of Service
Please read these terms before engaging our recovery services.
Effective date: 22 February 2026
These terms apply when you engage Kapiti Recovery ("we", "us", "our") for vehicle recovery, extraction, or related services.
1. Nature of Service
We provide 4WD vehicle recovery services across the Kapiti Coast and surrounding areas. This includes — but is not limited to — beach recoveries, hill and off-road recoveries, and getting vehicles back to a road where a tow truck can reach them. We are not a tow truck operator.
2. Best Efforts
All recovery work is carried out on a best-efforts basis. Every situation is different — sand, mud, water, slope, vehicle condition, weather, and access all affect what we can do. We will make every reasonable effort to recover your vehicle safely, but we cannot guarantee a successful outcome in every case.
3. Inherent Risks
Vehicle recovery in off-road environments carries inherent risks. These include but are not limited to:
- •Further damage to the vehicle being recovered (bodywork, underbody, drivetrain, towing points)
- •Damage caused by environmental conditions (sand, water, mud, rocks, terrain)
- •Mechanical failure of the vehicle during recovery
- •Personal injury to persons in or near the recovery area
By engaging our services, you acknowledge and accept these inherent risks.
4. Limitation of Liability
To the fullest extent permitted by New Zealand law, Kapiti Recovery is not liable for:
- •Any damage to your vehicle, its contents, or accessories arising during or as a result of the recovery process
- •Any indirect, consequential, or incidental loss (including loss of use, loss of income, or additional transport costs)
- •Any personal injury sustained during the recovery, except where caused by our gross negligence
You are responsible for ensuring all persons remain at a safe distance from recovery operations unless directed otherwise by us.
5. Vehicle Condition
We are not responsible for pre-existing damage or mechanical issues. Recovery operations may reveal or worsen existing damage that was not visible before the recovery began. By requesting our services, you accept this possibility.
6. Your Responsibilities
When engaging our services, you agree to:
- •Provide accurate information about your vehicle's location and condition
- •Follow all safety instructions given by our operator
- •Ensure all passengers and bystanders remain clear of the recovery area
- •Have authority to request recovery of the vehicle (i.e. you are the owner or have the owner's permission)
7. Payment
Payment is due on completion of the recovery. We will provide a quote or estimate where possible, but the final cost may vary depending on the complexity of the job. If additional equipment or operators are required, this will be communicated before proceeding where practical.
8. Cancellation
If you cancel after we have departed for your location, a callout fee may apply to cover our time and travel.
9. Privacy
We only collect the personal information needed to provide our services (name, phone number, location). We do not share your information with third parties except where required by law.
10. Governing Law
These terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the New Zealand courts.
